Sweden – New Contract Content for ICT for Employers Outside of EEA

What has changed?

Effective September 5, 2018, the Swedish Migration Agency now requires Intra-Company Transfer (ICT) Employment contracts or assignment letters to include the following points for employers based outside the European Economic Area (EEA) that wish to send assignees on an ICT to Sweden:
  • Name and address of the employer outside the EEA
  • Employee’s name and address
  • Date employment outside the EEA commenced
  • Workplace address in Sweden
  • Short description of the employee’s duties
  • Wages and other pay benefits
  • Employee’s job title or title of service (not applicable to trainees)
Previously, the Swedish Migration Agency did not require specific content to be included in Employment contracts or assignment letters, as long as the main aspects were mentioned e.g. salary, job title, assignee’s name and allowances.

Who is affected?

Employers outside the EEA wishing to send employees on an ICT to Sweden.

What to expect

For employers outside the EEA wishing to send assignees on an ICT to Sweden, employment contracts or assignment letters must be re-drafted to include the new changes prior to obtaining signatures from each party.
If the signed employment contract or assignment letter provided to the Swedish authorities does not include the above content, additional documents may be requested by the authorities at a later stage in the immigration process, potentially delaying the application.
Additionally, for renewal applications, the above must also be included in extended employment contracts or assignment letters for those employees eligible to apply for a ICT renewal.
