India – Increased Financial Penalties for Overstay and Visa Violations/Late Registrations

What has changed

The Foreigners Regional Registration Offices (FRRO) and Foreigners’ Registration Offices (FRO) in India have increased the financial penalty regarding overstay, visa violations, and late registrations with immediate effect. The new late fee varies from USD $300 up to USD $500 per person, based on the nature of the violation and duration of overstay. These increased late fees are in addition to other penalties imposed on the visa holder, including but not limited to eviction from the country.

Previously, a flat fee of USD $30 per application was charged in case of late registrations. For overstays, officers determined the monetary penalty on a case-by-case basis in consideration of the clarification or reasoning provided.

Who is affected

All clients who employ or will employ foreign workers in India with employment visas.

What to expect

All India Employment Visa holders must follow the stipulations endorsed on issued Visa label and register with jurisdictional FRRO/FRO within the stipulated fourteen (14) calendar days post-arrival in India.

For any delays in registrations beyond the fourteen (14) day period, the revised higher late fee will be charged.

The increased late fee will be levied in addition to any other penalty imposed such as issuance of Exit Permit, unfavorable remarks or observations on the visa, resulting in future travel ban into India for the visa holder.
