What has changed?
Effective September 19, 2018, the Hong Kong Immigration Department will start accepting applications for dependent visas for same-sex spouses who are legally married in countries where the relationship is legally recognized.
Previously only legally married spouses of the opposite sex were eligible to obtain dependent visas.
Who is affected?
All clients who have employees who are legally married to a same-sex spouse in a foreign country where same-sex marriages are legally recognized.
What to expect
All our clients who have spouses of the same sex and who are legally married in countries which legally recognize same-sex marriages will now be eligible to apply for the dependent visa.
Emigra currently assists with dependent visas for opposite-sex spouses in a marital relationship, and we will now extend our services to assist same-sex spouses who are married in countries which legally recognize same-sex marriages.
All other criteria of case assessment are in line with the standard Hong Kong dependent visa policy, and the final discretion for approval is per the case officer and the Hong Kong Immigration Department.
