What has changed
All Colombian legal entities and companies who currently employ foreigners on their payroll (or hired their services through a commercial agreement) are required to register these employees with the Registry of Foreign Workers in Colombia (RUTEC – Registro Único de Trabajadores Extranjeros en Colombia), as per Resolution 4386 of 2018 which was published on October 9, 2018.
Who is affected
All clients with foreign employees (already engaged or who will be engaged) under an employment or commercial contract in Colombia.
What to expect
Clients with foreign employees who are already employed or under commercial contracts must proceed with RUTEC registration no later than February 9th, 2019 which is one-hundred twenty (120) calendar days after the issuance of Resolution 4386 published on October 9th, 2018. This is applicable to all visa types in which an employment/commercial contract is involved (entry permits such as PIP6 and PIP5 are not under this obligation).
Clients who hire foreign workers under an employment or commercial contract in Colombia, have the duty to register them with the RUTEC within one-hundred twenty (120) calendar days counted from the employment start date.
Other requirements include registration of any of the following occurrences within thirty (30) days: contract terminations, changes in economic activity, and the foreigner’s permanent change of residence (new residence upon move to another city).
