Brazil – Changes to Technical Visa for Emergency and Urgent Situations

What has changed

On October 16, 2018, the Brazilian Immigration Council approved Normative Resolution No. 34/2018 which modifies the 180-day technical visa. The Normative Resolution No. 34/2018 partially alters the text of Normative Resolution No. 03/2017; the 180-day technical visa now is available only for emergency and urgent situations.

Previously, 180-day technical visas were available to any applicant whose assignment in Brazil was 180 days or less.

Who is affected

All clients planning to send employees to Brazil in the upcoming days/months.

What to expect

Emigra will inform our clients about any impact the changes may have on processing times for the 180-day technical visa for emergency and urgent situations. Previously, the processing time for pre-approval of the 180-day technical visa was five (5) to ten (10) days.

Currently, there is no provision to define the criteria for emergency and urgent situations nor to differentiate between the two. Emigra Worldwide will keep clients informed about updates related to procedures for the technical visa for emergency and urgent situations.

If there are no urgent or emergency situations, applicants may apply for a technical visa valid for one (1) year (Normative Resolution No. 03/2017). Processing time for pre-approval of this technical visa is currently an estimated thirty (30) to forty-five (45) days.
